Every Pocket Tells A Story Giveaway

By participating in the Every Pocket Tells a Story Giveaway (the “Giveaway”) that is conducted by One Finance, Inc. (“Sponsor”) and that links to the Official Rules , you agree to the Official Rules. These Official Rules are a contract between you and the Sponsor, so read carefully before participating. These Official Rules include indemnities from you to the Released Parties (defined below) and a limitation of your rights and remedies. You must comply with these Official Rules in order to be eligible or to receive a prize in the Giveaway. The Sponsor of this Giveaway is One Finance, Inc., P.O. Box, 162227, Sacramento, CA 95816-2227. 

PRIZES: There are 3 total prizes per week, in the form of ONE branded merchandise and $50. The total value of this Giveaway is $750 ($150 in merchandise and $600). 1 prize will be awarded on each platform - Twitter from @joinoneapp, Instagram from @joinoneapp, and Facebook at facebook.com/joinoneapp per week, 12 winners total. After the final entry period, one of the selected winners could also have their story selected to become the plot of a future campaign video.

PROMOTION PERIOD: Promotion period begins at 9:00 am Pacific Time (“PT”) on Tuesday, March 8, 2022 and ends at 3:59 pm PT on Wednesday, April 13, 2022 (“Promo Period”) and consists of six (6) separate, independent entry periods (each an “Entry Period”), as outlined in the chart below. Winners will be announced at 5:00 pm PT on each Entry Period Drawing Date. For avoidance of doubt, Sponsor’s computer is the official time-keeping device for the Promotion.

ELIGIBILITY: The Giveaway is open to all legal U.S. residents currently residing in the fifty (50) United States and the District of Columbia who are eighteen (18) years or older as of the date of entry. 

HOW TO ENTER: Participants can enter on Twitter, Instagram, and Facebook.

During the Promotion Period, go to Instagram.com, Twitter.com or Facebook.com and: 

1. Like the specified post 
2. Follow the “joinoneapp” account on the platform of entry
3. Reply to the specified post with the story behind one of the entrant’s Pockets
4. Make sure your profile is public so we can see your entry

ALTERNATE METHOD OF ENTRY (“AMOE”): Mail an Every Pocket Tells a Story Giveaway Entry Form (“Entry Form”) to One Finance, Inc. P.O. Box, 162227, Sacramento, CA 95816-2227, Attn: Giveaway Department, with entrant’s name, physical street address, phone number, and email address. You can download the Entry Form by clicking the link here. 

NO PURCHASE IS NECESSARY. 

Entries with incomplete fields in the Entry Form will not be accepted for entry into the Every Pocket Tells a Story Giveaway. 

Once the Entry Form is received and accepted, an acknowledgment email will be sent that the entry is in running for prize winning. If the prize is awarded to an AMOE entrant, the prize will be mailed to the address provided by the entrant within 15 days of random drawing. 

By completing the above requirements, you will receive one (1) entry in the Entry Period drawing associated with either the time of your reply or the time your Entry Form acknowledgment email was sent as well as the subsequent Entry Period drawing for the prizes offered to social media users. Sponsor, in its sole discretion, may disqualify any entry that it finds unlawful, or in violation of these Official Rules or any entrant whose public social profile demonstrates conduct that could damage the reputation of or reflect unfavorably on Sponsor.

RANDOM DRAWINGS; ODDS: The potential winner(s) will be selected by random drawing from among all eligible entries received under the Sponsor’s supervision and announced at 5:00 pm PT on each Entry Period Drawing Date. Subject to verification of eligibility and compliance with these Official Rules, the potential winner(s) will be declared the official winner(s) of the applicable Giveaway. Odds of winning depend on the total number of eligible entries received. Limit one (1) prize per person, per household, per Giveaway. 

PRIZES: Each winner will receive $50 and a ONE merchandise prize pack which will be mailed to the address provided by the entrant within 15 days of random drawing. The prize will be randomly chosen for each winner. Each winner is fully responsible for any and all applicable federal, state, territory, and local taxes (including income and withholding taxes). Prizes are non-transferable and non-assignable, with no cash redemptions except at the Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute any prize (or any portion thereof) with a prize of comparable or greater value at its sole and absolute discretion. 

One Finance, Inc. (or its designee or representative) will select the winner(s) of the Prize(s) in a random drawing from among all entries received during the Entry Period. The odds of winning are based on the number of eligible entries received during the Entry Period.

Winners will be notified via direct message through the social media account from which the winning applicants were selected. If the prize is awarded to an entrant who does not have a One account, the $50 prize will be mailed via gift card to the address provided by the entrant within 15 days of random drawing. If the prize is awarded to an entrant who does have a ONE account, ONE will deposit $50 into the winner’s Spend Pocket within 15 days of random drawing.

If One Finance, Inc. chooses to use one of the winning entries for the plot of a future campaign video, the winner will be notified within 15 days after the final Entry Period of the Giveaway by email and/or social media account (via direct message) provided at the time of entry.

NOTIFICATION: Each potential winner will be notified at the email address, postal address, telephone number, and/or social media account (via direct message) provided at the time of entry (the "Prize Notification"), as determined by the Sponsor within five (5) business days of eligibility. Winners may opt-out of participation upon notification. One Finance, Inc. shall have no liability for winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. Each potential winner will be required to submit his/her valid social security number and/or other identification to the Sponsor. Each potential winner will be required to execute and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, a Release of Publicity, within twenty-four (24) hours of the time of issuance (or such other timeframe as specified by the Sponsor). Failure to submit any identification required by the Sponsor within three (3) business days of receiving such a request from the Sponsor, noncompliance with these Official Rules, or the return of the Prize Notification or of the prize (or any portion thereof) as non-deliverable may result in the potential winner’s disqualification and prize forfeiture and, at the Sponsor’s sole discretion and time permitting, may cause an alternate potential winner to be randomly selected from among all remaining eligible entries. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT ONE FINANCE, INC.’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE PROMOTION, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED. 

ENTRY PUBLICATION, LICENSE, AND RELEASE: By entering the Giveaway, each entrant (a) agrees that his/her/their entry does not violate the One Privacy Policy (accessible on our Policies and Privacy page), or infringe upon the copyright, trademark, or other intellectual property rights, or rights of privacy or publicity, of any person or entity; (b) releases in perpetuity the Released Parties (as defined below) from any claims, demands, losses, and liabilities of any nature arising out of or in any way connected with the entry and use thereof as permitted hereunder, including, but not limited to, claims of copyright or trademark infringement, false endorsement, libel, slander, defamation, or infringement of rights of publicity or privacy. Nothing herein will obligate the Sponsor to make any use of any of the rights set forth herein. 

WAIVER OF LIABILITY/PUBLICITY RELEASE: By entering the Giveaway, each entrant agrees to (a) be bound by these Official Rules, including all entry requirements, and (b) waive any and all claims against the Sponsor and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives, advertising and promotion agencies, and any other company associated with the Giveaway, and all of their respective officers, directors, employees, agents, and representatives (collectively, “Released Parties”) for any injury, damage, or loss that may occur, directly or indirectly, in whole or in part, from participation in the Giveaway, receipt or use of any prize (or any portion thereof), or any travel or activity related thereto. By entering the Giveaway, each entrant gives his/her/their express permission to be contacted by Sponsor by telephone, email, and/or postal mail for Giveaway purposes. Each winner, by acceptance of the prize, grants to Sponsor the right to publicize his/her/their name, city and state/territory of residence, prize information, photograph, voice, statements, and/or other likeness for advertising, promotional, trade, and any other purpose, in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law. 

GENERAL CONDITIONS: The decisions of the Sponsor are final and binding on all matters relating to this Giveaway. Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due, or garbled entries, transmissions, email, or mail; lost, interrupted, or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections; availability, accessibility, miscommunications, or failures of computer, satellite, telephone, cable, or wireless transmissions or lines; computer hardware or software malfunctions, failures, or difficulties; wireless service congestion; failures or malfunctions of phones, phone lines, telephone systems, wireless towers, or cellular tower equipment; any error, omission, interruption, defect, or delay in wireless or other transmission, processing, or communication; printing, typographical, or other errors appearing within these Official Rules, in any Giveaway-related advertisements, or other materials; or any other errors, problems, or difficulties of any kind, whether human, mechanical, electronic, or other, relating to the Giveaway, including, without limitation, errors or difficulties which may occur in connection with administration of the Giveaway, processing of entries, announcement of any winner, or any Giveaway-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users (e.g., hacking) or by any equipment or programming associated with or utilized in the Giveaway. Released Parties are not responsible for injury or damage to the entrant’s or to any other person's computer and/or wireless device related to or resulting from participating in this Giveaway or downloading materials from or use of the Giveaway website. Persons who tamper with or abuse any aspect of the Giveaway or website; attempt to undermine the legitimate operation of the Giveaway by cheating, deception, or other unfair playing practices; intend to annoy, abuse, threaten, or harass any other entrant or any representative of Sponsor; or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Giveaway and to resolve all disputes in its sole discretion. Released Parties (a) make no warranty, guaranty, or representation of any kind concerning any prize (or any portion thereof) and (b) disclaim any implied warranty. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Sponsor reserves the right, in their sole discretion, to modify, suspend, extend, or cancel the Giveaway (or any portion thereof) in the event Sponsor is prevented from executing the Giveaway as contemplated herein by any event beyond Sponsor’s control, including but not limited to: fire; flood; earthquake; explosion; public health epidemic or crisis; labor dispute or strike; act of God or public enemy; network or equipment failure; riot or civil disturbance; terrorist threat or activity; war (declared or undeclared); court order; or federal, state, or local government law, order, or regulation. Sponsor also reserves the right, in their sole discretion, to modify, suspend, extend, or cancel the Giveaway (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes or events corrupt administration, security, fairness, integrity, or proper operation of the Giveaway. In the event of cancellation, the Sponsor may elect to identify the winner and award the prize by way of random drawing from among all non-suspect, eligible entries received up to the time of cancellation. The Sponsor also reserves the right, in its sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Giveaway. 

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR OTHER PROPERTY ASSOCIATED WITH THIS GIVEAWAY OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT, AND THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. 

Entries generated by a script, macro, or other mechanical or automated means will be disqualified. ARBITRATION; CLASS ACTION WAIVER: As a condition of entering this Giveaway, each entrant agrees that (a) any and all disputes, claims, controversies, or 

causes of action arising out of or relating to this Giveaway or any prizes awarded (each, a "Claim") shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party. This is subject to applicable federal laws and, to the extent that state law applies, the laws of the state of California and other applicable rules without regard to conflicts of law principles (except to the extent that this Agreement can and does vary such laws). 

WINNERS LIST: For a winner(s) list, mail a request specifying the applicable Giveaway and entry period (Example: Every Pocket Tells a Story Giveaway) and a self-addressed stamped envelope to be received no later than ninety (90) days after the end of the applicable entry period on April 13, 2022 to Every Pocket Tells a Story Winners List, c/o One Finance, Inc. located at P.O. Box, 162227, Sacramento, CA 95816-2227 Attn: Giveaway Department.
